California officer confused the lighter with a gun and shot burglar suspect sitting inside toilet: VIDEO
Fontana Police Department released the bodycamera video which shows a foot chase after a burglar suspect. This video was released during an active investigation into the deadly shooting.
The male suspect was identified as 28-year-old Deverion Kinard, who was killed 1 day before his 29th birthday.
During the investigation, it was established that the man captured on surveillance cameras around the house and the man who was shot in the mobile toilet are the same person. But, after chasing an unidentified person, the officer, not making sure of the identity of the man sitting on the toilet, opened fire fearing a lighter.
In a video statement, Fontana Police Chief Billy Green said a metallic object was visible in Kinard’s hand before Officer Johnny Tutiavake fired.
“The suspect ran south from the victim’s residence through several neighborhoods,” Fontana police officials wrote in the statement. “Officers located the suspect hiding in an outbuilding and an officer-involved shooting occurred.”
The officer was identified as Officer Johnny Tutiavake. As compensation for the death of an unarmed burglar, the city agreed to pay $ 1 million to the Kinard family.
Jacquelyn Rodriguez, a spokeswoman for the DA’s Office, said her agency has not received Fontana’s investigatory report. District Attorney Jason Anderson will determine whether the shooting violated criminal law, while Fontana’s internal investigation will determine whether the shooting violated department policy, reports the Press-Enterprise.
Tutiavake remains on duty.
