Jeffrey Toobin Predicts 'Abortion Will Be Illegal' in 20 States after Justice Kennedy Retires

WASHINGTON, DC – June 29, 2018

CNN legal analyst Jeffrey Toobin predicted that abortion would soon be illegal in many states within months of Supreme Court Justice Anthony Kennedy’s retirement.

The retirement of the 81-year-old justice, who has served on the U.S. Supreme Court for 30 years, gives President Donald Trump an opportunity to place a more solidly conservative judge in Kennedy’s place, tilting the nation’s highest bench further in favor of Republicans.

“Anthony Kennedy is retiring. Abortion will be illegal in twenty states in 18 months”. Jeffrey Toobin tweeted, soon after Kennedy made his announcement. 

He followed up that message in a Wednesday appearance on CNN:

“Let’s talk about facts. Let’s talk about what America is like that is going to be different. You’re going to see 20 states pass laws banning abortion outright. Because they know there are going to be five votes on the Supreme Court to overturn Roe v. Wade,” Toobin said.

There was “just no doubt,” Toobin noticed, that abortion would be illegal in a significant part of the United States within a year and a half. 

“Roe v. Wade is doomed,” he added. “It is gone because Donald Trump won the election and because he’s going to have the chance to appoint two Supreme Court justices.”

Since the retirement of Sandra Day O’Connor 2006, Kennedy has served as the court’s resident swing vote, siding with both the court’s liberals and conservatives depending on the issue.

In addition to abortion, he has also been a frequent supporter of LGBT rights on the bench, writing several critical decisions over the years, including the 2015 opinion which legalized same-sex marriage.
