Omaha man accused of killing registered sex offender only because of his concerns
Omaha man arrested for killing a registered sex offender in an attempt to protect the neighborhood.
Indeed, the road to hell is paved with good intentions. Police say they arrested 43-year-old James Fairbanks for fatally shooting 64-year-old Mattieo Condoluci in his home last week. Fairbank was searching for an apartment in the neighborhood when he learned about a sex offender living in the area.
Fairbanks, who worked in a middle school alternative program at the time of the incident and helped abused children, according to the Omaha Public School official, apparently decided to help his potential new neighbors to get rid of the alleged threat in the face of Condoluci.
“He was dedicated to helping kids who are vulnerable and had special needs, he worked with them for his whole career in schools, in correctional facilities, in group homes,” Fairbank’s ex-wife Kelly Tamayo said.
After the murder Fairbanks called his ex-spouse and confessed in killing.
“Jim contacted me yesterday afternoon to tell me he had killed a child molester. He said he was in preparation of turning himself in and he had sent an email already to the police department,” Tamayo said. “He was ready to take full responsibility for it, he knew what the consequences were.”
The couple divorced in 2018 following the court protection order filed by Tamayo although Fairbanks didn’t have a history of violent crimes.
Fairbanks was concerned about the swings and a wooden playground in his backyard. But according to the landlord of the home where Concoluci lived, the man installed the swing a year ago when his brother and a nephew came to visit from out of state. Landlord also said that Condoluci have lived in the neighborhood for a decade and never caused any problems.
According to the Nebraska Sex Offenders Registry, in 1994, Condoluci was arrested in Florida for attempting to sexually touch a child under 16. He was also arrested in Nebraska for sexaully assaulting a child in 2007. On March 2, 2020 Condoluci’s had his last compliance check with the Douglas County Sheriff's Department.
“I just pray for understanding and leniency when it comes to his consequences, because he is a good man and he was acting out of the goodness of his heart to protect people,” Tamayo said trying to somehow justify her ex-husband.
Fairbanks is being held inside Douglas County Corrections for criminal homicide.
